Solicitors failed to ensure adequate rights of access

Coodes’ Solcitor Ben Sidgwick acted for Mr & Mrs C. They had purchased a property but their former solicitors had failed to ensure that they had adequate rights of access. Following attempts at pre-action settlement, we issued a professional negligence claim against their former solicitors. Via negotiations with the neighbouring owners, Mr & Mrs C secured adequate rights of access and these were formalised by us. Their former solicitors then settled the claim by paying Mrs & Mrs C damages and reimbursing them for the costs and expenses that they had incurred.
