The local dairy farmer dispute

Coodes’ Solicitor Andrew Marshall acted for Peter the local dairy farmer. He engaged specialist contractors to build a new dairy complex on his farm. Upon completion of the new dairy, it soon became apparent that there were significant issues with the quality of the concrete roads and aprons which formed part of the new unit.

A claim was brought against the contractors, who initially contested the claim. Part of the contractors’ defence was that the problem lay with the Architect who had initially designed the new dairy and who had provided the specification for the concrete.

The claim was settled without the need for Court proceedings, with the contractors agreeing to replace the failing concrete, mostly at their own cost. The specification and programming of the agreed remedial works were recorded in a detailed written Settlement Agreement.
