Like any business, you want to get the very best from your staff to make your business as successful as possible. Sometimes, however, staff do not work at their optimum. Whatever the cause of unsatisfactory performance, we can assist you in formally dealing with the underlying issues, including introducing capability measures, both to help staff improve and to deal with any disciplinary procedures.

Where performance management issues are not appropriate or have failed to deliver the required improvements, we can also negotiate terminations and defend any subsequent Employment Tribunal claims. Having good processes in place from the outset as part of your HR documentation will be invaluable in making employment law work for you and protecting your business from unwanted, expensive and reputationally damaging claims. If disciplinary action does result in dismissal, you may wish to introduce or enforce restrictive covenants to ensure that your former employee cannot undermine your business from the outside, either by working for a competitor, setting up in direct competition or leveraging proprietary or confidential information and IP. We can support you in framing and managing restrictive covenants to ensure that they are relevant, enforceable and not subject to challenge.
