Workplace harassment and bullying

Workplace harassment and bullying – advice for employers

A safe, respectful workplace is central to employee wellbeing and productivity, and ultimately to business success. Allegations of workplace harassment or bullying can be highly disruptive, affecting morale, increasing staff absence and turnover, and potentially exposing employers to serious legal and reputational risk.

Issues of workplace harassment or bullying require careful, timely and informed handling to protect both your staff and your organisation. At Coodes, we advise employers across the region on preventing, managing and responding to workplace harassment and bullying issues. We support organisations in creating positive working environments and in dealing robustly and fairly with complaints when they arise.

Understanding employer responsibilities

Employers have a legal duty to provide a safe working environment and to protect employees from harassment, discrimination and inappropriate behaviour at work. Harassment may be linked to a protected characteristic under equality legislation, or it may arise more broadly as workplace bullying. In either case, the result can be significant legal exposure, including constructive dismissal, discrimination and personal injury claims.

Crucially, employers can be held liable for the actions of their staff towards colleagues, clients, customers and suppliers, including any abusive, discriminatory or otherwise inappropriate behaviour. If it happened at work, it’s the employer’s responsibility. It is therefore essential to establish, communicate and consistently uphold clear standards and policies.

How we can help

Our specialist employment team can provide practical support tailored to your organisation including:

  • Reviewing and updating anti-harassment and dignity at work policies, ensuring they are compliant and clearly understood.
  • Advising on handling complaints and grievances, including suspension, investigation and disciplinary processes.
  • Supporting internal investigations, ensuring they are fair, thorough and legally robust.
  • Providing training for managers and HR teams, equipping them to recognise issues early and respond appropriately.
  • Defending claims in the Employment Tribunal, including harassment, discrimination and constructive dismissal claims.

Compensation for successful claims can be uncapped and the management time involved can be very significant. It is vital that you ensure your business is protected and following best practice, wherever possible addressing issues before they reach the formal claim stage.

Contact our expert employment team if you are facing a claim or are concerned about an issue developing. We can help you choose the best approach to protect your business and staff.
