Legal Jargon

A remedy granted by the Court during proceedings, that remains in effect (normally) until a final hearing. An interim order may be awarded, for example, to preserve property or assets until the claim is resolved, or to protect an individual while their care is being considered.

A form of guarantee where one party agrees to compensate another party for any specific loss or damage caused by the first party’s action (or failure to act).

An Order made by the Court either to restrain a party from pursuing a particular course of action or alternatively an Order to force a party to take a particular action.

Form used to apply for reduction of or exemption from paying a court fee.

The property in which the parties last lived together during their marriage.

The form completed before each hearing and filed with the court setting out how much the proceedings have cost each party up to that point.

The first hearing in financial proceedings at which the court will set the timetable for the case, consider which parts of the questionnaire should be answered and whether any additional evidence is required, such as a formal valuation of the family home.

The court case which aims to resolve how the family finances (such as the home, pensions, savings and debts) will be dealt with upon a divorce or civil partnership dissolution.
