Abi Lutey heads the Commercial Dispute Resolution team.
Abi qualified in 2005 and her career has been devoted to advising clients and resolving commercial litigation disputes.
Abi specialises in commercial and rural property litigation including advising clients on landlord and tenant matters to include lease renewals, forfeiture, dilapidations and repairing obligations.
Abi also has a particular interest in agricultural property disputes and is a member of Agricultural Lawyers Association and the firm’s Rural Services Team advising her clients on agricultural tenancies and rural land disputes.
In addition, Abi regularly advises on contractual issues for clients to include completion disputes, and misrepresentation claims.
Her clients include private commercial landlords and tenants, companies, partnerships, charities, farmers and landed estates. She is commended for her ability to quickly find the underlying cause of her client’s issues, providing expert advice with skill and tenacity.
Abi has a good relationship with other property professionals in the local community, is a member of the Property Litigation Association and regularly delivers property law update lectures to commercial property agents.
Successfully acting for a client in a claim brought against them in the Business and Property Court, seeking a declaration that the contract remained extant between the parties, stating the notices to complete served were invalid. The claim was high value and resulted in a successful summary judgment application together with damages and costs.
Abi successfully settled a claim for a commercial tenant claiming a breach of lease where there was an express right of support arguing a derogation from grant and right to quiet enjoyment.
Abi successfully advised on a complicated partnership dispute where relations had broken down between the family partners. The case was multi-faceted and included claims of proprietary estoppel. After a successful mediation the parties were able to avoid the dissolution of the partnership and continue to farm successfully.
