Notable Children Law cases

  • Relocation from another country

Obtaining an order enabling a mother and the children to remain in England and Wales following a relocation from another country.

  • Child arrangements

Representing the mother in an application made for the Father to be able to see his child. There were issues of domestic abuse raised which the court had to consider as part of the proceedings. A restraining order was obtained for the client which prevented the father from knowing the mother’s whereabouts and from being able to spend any time with the children.

  • Relocation and schooling arrangements

Representing a father in proceedings which had been brought to relocate a child from Cornwall to another part of the country. The Mother had moved with her other children and believed that the court would agree to her child moving with her. It did not and the child remained in Cornwall at their school.

  • Parental alienation

Representing parties where parental alienation has been alleged by one parent which resulted in them being denied any contact with their children. Following investigation and intervention from the courts, contact was reinstated.

  • Declaration of parentage

Advising on a case where the Father did not have parental responsibility for the child and was not named on the birth certificate and applying to the court and obtaining a declaration of parentage and for the birth certificate to be amended to provide him with parental responsibility.

  • Parental responsibility

Assisting with an application which was made by a father who obtained parental responsibility when he was named on the birth certificate. It transpired during the proceedings that he was not the natural father and should not have been named on the birth certificate. Despite this, the court allowed him to retain his parental responsibility and to share the care of the child.

  • Grandparents

Assisting with applications from grandparents to be able to spend time with their grandchildren.

  • Special Guardianship orders

Obtaining an Order that grandchildren were to live with their grandparents for the rest of their childhood.

  • Assisted reproduction

Assisting a client with legalities around parental responsibility when a child was conceived using a donor embryo.

Sarah represents both parties in domestic abuse cases, obtaining protective court orders for them and any related children or assisting them if any protective orders have been made which are contested.
