Domestic Abuse
We understand the terrible position of being in fear for your own safety or that of your children and that for domestic abuse victims it can often be difficult to take that first step to doing something about it.
Domestic abuse does not just mean physical violence but also includes emotional, psychological, financial and sexual abuse of a spouse, partner, child, former partner, family member or associated person. Domestic abuse, in any form, should not be tolerated and we can help you take those first steps towards breaking free from the cycle of abuse.
We will help you to decide which sort of restraining order you might need, whether it is a non-molestation order (to protect you physically) or an ouster or occupation order (to regulate occupation of a house).
We have close links with the police and domestic abuse support agencies throughout Devon and Cornwall and will liaise with them throughout your case to ensure the best outcome for you and your family.
Legal Aid is available for victims of domestic abuse, subject to your financial situation, and we are always willing to carry out a free initial assessment to see if you will be eligible. If you are eligible this will enable us to immediately advise you on what action can be taken to protect you and, in urgent circumstances, we can make an emergency application to the court to obtain protection for you and your children.
Likewise, we appreciate how difficult it can be to be accused of violent behaviour and face the possible loss of your children, home and even possibly your liberty as a result of false accusations being made. We represent many victims of Domestic Violence as well as many respondents and always treat each in a fair and even handed way.
Whatever your circumstances, we will always treat you with respect and sympathy at every stage of the process.
