Approximately half of Ed’s caseload is probates of all types. He specialises in complex farming estates. The remainder of his time is spent dealing with Wills and Lasting Powers of Attorney.
The estate included a simmering family dispute, foreign properties and foreign beneficiaries, a large Inheritance tax bill and various unregistered properties that needed to be sold to attain the best price for the estate.
The estate administration was completed with the help of foreign lawyers to the satisfaction of all the family.
Although the final IHT bill was large it was substantially reduced by successful Business Property relief and Double Taxation claims and a Section 173 (Foreign Assets Expenses) claim.
A father died suddenly of cardiac arrest leaving his adult disabled son of limited mental capacity alone in the family home and with no other close family nearby. The closest family member living far away.
Working with the son, local social services, a consultant Psychiatrist and local support teams we arranged the administration of the deceased father’s estate and the son’s ongoing finances and affairs so that he could continue to live in the family home with local support and ongoing oversight from his cousin.
Preparing a will for clients who farm in partnership with a third party. One of their children has some additional needs and neither of their children are likely to be in a position to take over the farm, so there is a need to safeguard their inheritance.
Along with Coodes Corporate and Commercial solicitor, Kirsty Davey, and our clients’ accountant we created and agreed a suitable farm partnership agreement that included the family’s plans for succession of the farm business whilst also maximising the Inheritance Tax reliefs available to families, farmers and business owners. We then created Wills that dovetailed with the partnership agreement and IHT aims but which also created suitable discretionary trusts to protect the children and the farm assets.
The final step was to complete powers of attorney to deal with ongoing functioning of the farm in the event of an accident or stroke.
