Contentious Court of Protection Matters

Our specialist Contentious Court of Protection team has wide-ranging experience in dealing with problems and disputes that relate to individuals who lack capacity, and the people appointed to make decisions and manage their affairs, such as attorneys and deputies.

Court of Protection matters are, by definition, sensitive – they involve people who are vulnerable, who lack capacity to make certain financial and personal welfare decisions, either at all or without specialist support. They may be confused or upset by any change to their lives and the people who support them. Similarly, where individuals are accused of failing to carry out their duties effectively or worse, fraudulently or abusively, emotions can run high.

When a dispute arises in relation to a vulnerable person’s affairs, the Court of Protection has the jurisdiction to get involved and resolve the issues. We approach all the cases with sensitivity and respect to the individuals affected. Our aim is to ensure that the rights, assets and quality of life of the vulnerable individual are preserved and protected. These cases are often complex, and may involve family members, care providers and other professionals.

We advise on a wide range of issues relations to the Court of Protection, including:

  • Objections to applications for lasting powers of attorney or the appointment of a deputy
  • Challenging decisions or action taken by attorneys and/or deputies
