Functional Neurological Disorder (FND)

If you or a loved one has suffered functional neurological disorder (FND) as a result of an accident, you may be entitled to compensation for your injury and its consequences. This includes any loss of earnings you suffer and care costs you or your family have to pay. With years of experience advising on FND, we are here to help.

FND is a complex condition and can be hard to diagnose – but we know that its impact can be both upsetting and life-changing. FND can be triggered by physical injury or illness, or even by psychological damage resulting from a traumatic experience. However, the most common trigger is a physical event, such as an accident at work or a road traffic accident. Even relatively minor incidents can lead to FND, so it is not a condition associated solely with catastrophic injury.

With such complex causes behind FND, it is important that you have the right team in your corner; legal experts who understand the human impacts of FND and who have experience in building effective cases to help you get the support you deserve.

Make a claim for FND

If you have been diagnosed with FND following an accident that wasn’t your fault, or you are experiencing unexplained neurological symptoms after a traumatic event, contact our specialist personal injury and clinical negligence teams. Your initial conversation will be confidential and without obligation. Our expert FND lawyers can help you to understand your options and, where appropriate, make a claim against the individual or organisation responsible.

What is Functional Neurological Disorder?

FND is a condition involving problems with how the brain and nervous system send and receive signals. Medically, it sits at a point between neurology and psychiatry. In the past, it was poorly understood and even stigmatised but advances in medical care mean that today FND is recognised as a serious neurological condition with real and measurable impacts on people’s lives. Today, at least 50,000–100,000 people in the UK suffer from FND.

What makes FND claims especially challenging is that the condition may not show up in conventional scans and it can affect different people in different ways – including leaving people who have experienced the same trauma either profoundly impacted by FND or completely unaffected. Sufferers of FND can find themselves unable to drive or work, and in severe cases, unable to live independently. Symptoms can also change on a daily basis, meaning one day you may experience weakness in a limb, but the following day the limb feels ‘normal’ again only to then feel weakness again a week later.

What does FND look like?

The term FND describes the cause of an issue rather than the way it shows up and, critically, those issues may not be evident straight away. They can also be experienced alongside and be masked by other injuries and conditions. Sufferers of FND can experience a wide range of a wide range of issues, including:

  • Limb weakness or paralysis
  • Non-epileptic seizures
  • Tremors and spasms
  • Difficulty walking, dizziness or balance issues
  • Sensory disturbances
  • Speech and swallowing difficulties
  • ‘Brain fog’ – difficulties concentrating
  • Memory problems
  • Mental fatigue

How we can help

As experts in personal injury and clinical negligence claims, we can help you make a claim for FND where it results from another individuals or organisation’s actions, carelessness or negligence. Often this will mean addressing objections, obstacles and scepticism thrown up by the individual or organisation’s insurer. We are experienced in this process and in overcoming these challenges.

The financial implications of FND can be significant and long-term, covering not just immediate losses but potentially years of ongoing care, rehabilitation, home adaptations, and lost earnings. Around 40% of people diagnosed with FND improve within a year – but for others, symptoms persist or become chronic. This uncertainty is one of the reasons that you need experienced specialists to handle your claim. We provide a comprehensive FND claim service that covers:

  • Specialist support at every stage – FND claims demand a level of expertise that goes far beyond standard personal injury work
  • Expert medical evidence – we instruct neurologists and neuropsychiatrists who specialise in FND
  • Early rehabilitation funding – we will work to secure interim funding for rehabilitation under the Rehabilitation Code, regardless of whether liability has been admitted. Early access to specialist physiotherapy and psychological therapy can make a significant difference to outcomes.
  • Comprehensive case-building – we will gather medical records, GP notes, employment history, and witness statements from family and colleagues to build a complete picture of life before and after the accident and robustly establish causation.
  • Navigating scepticism – insurers may argue that your symptoms are exaggerated or pre-existing. We understand the nuances of how FND presents and know how to counter these arguments with authoritative evidence.

No win, no fee

Most of the FND claims we support are handled on a no win, no fee basis, which means:

If you win your case your opponent will pay the majority of your legal costs. Any legal costs not paid by your opponent and the lawyer’s success fee will be deducted from the compensation that you receive.

If you lose your case, you will not have to pay any legal costs unless we advise you otherwise.

How long do I have to make an FND claim?

You usually have up to three years from the date of the accident or knowing about your injury to start a FND claim. There are some exceptions and we will advise you about these when we speak. We recommend that you contact us as soon as possible, so our personal injury and clinical negligence lawyers can explain the process of claiming compensation, start your claim and help you access any other support and/or rehabilitation you need.

How much compensation could I receive?

Every FND claim is different and so is its impact on you or your loved one. That is why it is important to get expert advice from qualified specialist lawyers who really understand the unique nature of the claim and who are experienced in working with medical professionals to truly understand the impact of FND and how it may affect you in the long term.

The amount you can claim will depend on a number of factors, including the severity of your condition, any financial losses you have suffered or will suffer in the future, and any changes to your lifestyle that you have to make as a result of your condition. Whatever the impact of your FND, our specialist personal injury and clinical negligence lawyers will ensure that you get the compensation and support you are entitled to.
