Notable Probate and Estate Administration cases

• Inheritance Tax
  

  Dealing with an estate whereby the clients thought it would be subject to inheritance tax because the deceased had left her entire estate to her children and did not own a property.

  Lisa was able to claim the residence nil rate band in relation to the deceased’s former property which she had sold in 2017. This meant that there was no inheritance tax to pay.

• Grant of Probate
  

  Dealing with an intestacy where the deceased’s surviving spouse had unfortunately died before she was able to obtain a Grant in her late husband’s estate.

  As she was the only person entitled to his estate, the clients were unsure what steps could be taken in order to deal with his assets.

  Lisa advised them that they would be able to take out a Grant of their father’s estate as they were their mother’s personal representatives, and she was able to assist them with obtaining Grants in relation to both estates.
